1. Acceptance of Terms
By accessing or using the Software Services website and purchasing or downloading any software products ("Products"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the site or purchase any Products.
2. Eligibility
You must be at least 18 years of age to use this website and purchase Products. By placing an order, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement.
3. License Grant
Upon successful purchase and payment, you are granted a non-exclusive, non-transferable license to install and use the purchased Product on the number of devices specified by the product's activation limit. This license is for your personal or internal business use only.
- You may not redistribute, resell, sublicense, or share license keys with third parties.
- You may not reverse-engineer, decompile, or disassemble the software.
- You may not remove or modify any copyright notices or proprietary markings.
4. Payment & Pricing
All prices are displayed in South African Rand (ZAR) unless otherwise stated. Payments are processed securely through PayFast. By completing a purchase, you authorise PayFast to charge your selected payment method for the total amount.
Prices may change at any time without notice. However, any changes will not affect orders already completed and paid for.
5. Delivery
Products are delivered digitally. After successful payment, you will receive a license key and download access. Delivery is typically immediate upon payment confirmation, but may take up to 24 hours in rare cases.
6. Activation & Device Limits
Each license key has a maximum activation count. You may activate and deactivate machines via the License Lookup page. Exceeding the activation limit requires purchasing additional licenses.
7. Subscription Services (SaaS)
Certain Products may be offered as subscription-based services ("SaaS Products") with recurring billing (monthly or annual). The following additional terms apply to SaaS Products:
- Recurring billing — By subscribing, you authorise automatic recurring charges at the specified interval until you cancel.
- Cancellation — You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
- Service availability — We aim to maintain reasonable uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.
- Data — Upon cancellation or termination, you will have 30 days to export your data. After 30 days, your data may be permanently deleted.
- Price changes — We may adjust subscription pricing with 30 days' written notice. You may cancel before the new price takes effect.
8. Acceptable Use
You agree not to use our Products or services to:
- Engage in any unlawful, fraudulent, or harmful activity.
- Distribute malware, viruses, or any other harmful code.
- Attempt to gain unauthorised access to our systems, servers, or other customers' data.
- Use automated tools (bots, scrapers) to access our website in an abusive manner.
- Share, resell, or sublicense your license key or account credentials.
- Circumvent or attempt to bypass license activation limits or copy protection.
- Use the Product in any manner that could damage, overburden, or impair our services.
Violation of this acceptable use policy may result in immediate termination of your license and/or account without refund.
9. Intellectual Property
All Products, including their code, design, documentation, and associated materials, remain the intellectual property of Software Services. Your license grants usage rights only — not ownership.
10. Disclaimer of Warranties
Products are provided "as is" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the software will be error-free or uninterrupted.
11. Limitation of Liability
In no event shall Software Services be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of any Product. Our total liability shall not exceed the amount paid by you for the specific Product giving rise to the claim.
12. Force Majeure
Software Services shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, fire, flood, or extreme weather events
- Power outages, internet or telecommunications failures
- Government actions, sanctions, or regulatory changes
- Pandemics, epidemics, or public health emergencies
- Cyber-attacks, DDoS attacks, or other security incidents
- Acts of war, terrorism, or civil unrest
- Third-party service provider outages (including PayFast, hosting providers)
We will make reasonable efforts to resume performance as soon as practicable and will notify affected customers of any significant disruptions.
13. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act (POPIA). By using our services, you consent to the practices described in our Privacy Policy.
14. Support
Basic support is provided through our Support Center. Response times are best-effort and are not guaranteed. We reserve the right to limit or discontinue support at our discretion.
15. Termination
We may terminate your license if you violate these Terms. Upon termination, you must immediately cease using the Product and destroy all copies in your possession.
16. Governing Law
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of South Africa.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
18. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Continued use of the site after changes constitutes acceptance of the updated Terms.
